Amazon Responds to Future Retail’s Pliance Deal: Delhi High Court

The Delhi Supreme Court on Tuesday requested Amazon’s response to a plea by Kishore Biyani, who led Future Retail, claiming the e-commerce major entered its deal with on the basis of an injunction from a Singapore arbitrator Reliance Retail got involved.

Justice Mukta Gupta urged Amazon, Future Coupons and Reliance Retail on the Future Retail suit and asked them to submit their written statements within 30 days.

The court also said the issue of the maintainability of the lawsuit raised by Amazon would remain open.

The order was approved after days of arguments in the name of Future Retail, Future Coupons, Reliance and partial arguments from Amazon.

The arguments on behalf of Amazon continue on Wednesday.

The Singapore International Arbitration Center (SIAC) issued an injunction in favor of Amazon on October 25th preventing Future Retail from disposing or encumbering its assets or issuing securities to secure funding from a restricted party.

Amazon then wrote to the market regulator SEBI, the stock exchanges and the Indian Competition Commission (CCI) asking them to consider the arbitrator’s interlocutory decision in Singapore as it is a binding order, FRL told the High Court.

Future Retail has urged the Supreme Court to prevent the US-based e-commerce major from writing to SEBI, CCI and other regulators about the appointment of SIAC as it is a disruption of the agreement with Reliance.
